These Terms of Service ("Terms") govern your use of the Amorithm dating platform ("Service") operated by Amorithm ("we", "us", "our"), accessible at amorithm.com. By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

1. Eligibility

• You must be at least 18 years of age to use Amorithm.
• By creating an account, you confirm that you are at least 18 years old and that the date of birth you provide is accurate.
• If we discover that a user is under 18, their account will be immediately terminated and all associated data will be deleted.
• You must have the legal capacity to enter into a binding agreement in your jurisdiction.

2. Account and Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. AI-Powered Service Disclaimer

Amorithm is an AI-powered dating platform. You acknowledge and agree that:

• AI-Generated Content: Profiles, compatibility scores, match reasons, and conversation starters are generated by artificial intelligence. They are algorithmic outputs, not human assessments.
• No Guarantee of Accuracy: AI-generated personality profiles, compatibility scores, and match recommendations are estimates based on limited conversational data. They may not accurately reflect you or your matches.
• No Guarantee of Results: We do not guarantee the quality of matches, compatibility between users, the success of any relationship, or any particular outcome from using the Service.
• AI Limitations: AI systems can produce inaccurate, biased, or incomplete results. Match scores and personality analyses should be treated as suggestions, not definitive assessments.
• Not Professional Advice: The Service does not provide relationship counseling, psychological assessment, or any form of professional advice.

4. User Conduct

You agree to use the Service lawfully and respectfully. You will NOT:

• Provide false or misleading information in your profile or conversations.
• Harass, abuse, threaten, or intimidate other users.
• Use the Service for any unlawful purpose or to facilitate illegal activity.
• Impersonate another person or entity.
• Send spam, solicitations, or commercial messages to other users.
• Attempt to manipulate the AI system or exploit vulnerabilities in the Service.
• Use automated systems, bots, or scraping tools to access the Service.
• Share explicit, offensive, or inappropriate content.
• Violate any applicable laws or regulations.

You are solely responsible for your behavior and any consequences that arise from your use of the Service, including messages sent and real-world interactions with other users.

5. User Indemnification

You agree to indemnify, defend, and hold harmless Amorithm, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or relating to:

• Your use of or inability to use the Service.
• Your violation of these Terms.
• Your violation of any rights of any third party.
• Your conduct in connection with the Service, including any interactions with other users (online or offline).
• Any content you submit, post, or transmit through the Service.
• Any real-world meetups, dates, or interactions arranged through or inspired by the Service.

6. Third-Party Interactions

Amorithm is not responsible for the actions, behavior, or conduct of other users.

• We do not conduct background checks on users.
• We do not verify the identity, accuracy of profiles, or intentions of users beyond basic account creation.
• Any interactions with other users, whether online or in person, are entirely at your own risk.
• We strongly recommend meeting in public places and informing someone you trust when meeting a match in person.
• We are not responsible for any damages, losses, or harm resulting from your interactions with other users.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory.
• We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
• In no event shall Amorithm be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of goodwill, emotional distress, or personal injury.
• Our total aggregate liability to you for any and all claims arising from your use of the Service shall not exceed the total amount paid by you to Amorithm in the twelve (12) months preceding the claim.
• If you have not paid anything to Amorithm, our maximum liability shall not exceed fifty US dollars ($50).

8. Intellectual Property

• The Service, including its design, code, AI algorithms, and branding, is owned by Amorithm and protected by intellectual property laws.
• You retain ownership of the content you provide (messages, personal information). By using the Service, you grant us a limited, non-exclusive license to use this content to provide and improve the Service.
• AI-generated content (profiles, match analyses) is generated using our systems and may not be claimed as your original work.

9. Data and Privacy

• Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
• By using the Service, you consent to the data practices described in the Privacy Policy.
• You have the right to request deletion of your data at any time through the dashboard.

10. Termination

• You may terminate your account at any time by requesting data deletion through the dashboard.
• We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason.
• Upon termination, your right to use the Service ceases immediately.
• Sections that by their nature should survive termination (indemnification, limitation of liability, disclaimers) shall survive.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting updated Terms on the platform. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Amorithm regarding your use of the Service, superseding any prior agreements.
